Historic decision in the Uber case: drivers are employees, not self-employed.
This is a historic victory that will be a milestone for the entire country. The decision taken by the State of Geneva is confirmed by the Federal Court, which rejected Uber's appeal. The company will therefore have to cease its activity while it complies with the law. In short, Uber drivers can no longer be considered self-employed, but are recognized as employees. State Councilor Fabienne Fischer, responsible for the economy and employment in Geneva, is delighted with the end of this long legal saga opposing Uber to the State of Geneva since 2019. It constitutes a major step forward for the respect of working conditions, the protection of employees and the fight against unfair competition. A victory that is all the more important since this case law will have consequences for all Swiss cantons.
