  • By using the website www.swissryde.ch (the Site) or Swiss Ryde Rider/Driver (the Application), you agree to the following terms and conditions (the General Conditions) stated below.

Access to the Website and your profile in our database:

  • Swiss Ryde is a platform that offers services, business management and innovation advice, and occasionally promotes all users: clients/drivers. The following terms and conditions apply to any access and use of our Site including individual profiles as well as any other associated content available on this platform. Your use of our Site and/or the Application constitutes your solemn consent to abide by the terms and conditions below, as well as any timely notified amendments.

Disclaimer:

  • Swiss Ryde assumes no responsibility for the content, accuracy, timeliness, reliability, or completeness of the information displayed, or that displayed due to misuse of the Site or produced by technical failures beyond our control.
  • In accordance with our General Conditions and your consent upon acceptance of these conditions, it is important to note that Swiss Ryde is a virtual platform designed to facilitate bilateral connection between passengers and drivers; therefore, from a legal standpoint, Swiss Ryde disclaims any liability for any event, of any nature, occurring between the two parties before, during, or after a trip booked through our platform. We encourage you to consult our General Conditions for more information regarding the responsibilities and obligations of each party.

Responsibility for links: 

  • While we are very careful in displaying links on our Site and Applications, the use of references and links to third-party websites is entirely at the user’s own risk and is not the responsibility of Swiss Ryde, which disclaims any liability.
  • Furthermore, you are not authorized to create links to our platform from any other website without obtaining prior written permission from us.

Copyright:

  • Copyright and all other rights to the content, images, photos, or other files of the Site and Applications belong exclusively to Swiss Ryde, its shareholders, partner organizations, or expressly named rights holders. For the reproduction of any element, written consent must be obtained in advance from the copyright holder.

Access to the service:

  • Although we strive to ensure the availability of our Site/Application at all times, we will not be liable in the event that our system should be temporarily suspended without notice due to force majeure, maintenance, repair, or for any other reason beyond our control. In such a situation, we will endeavor to restore all system services as soon as possible.

Lawful Use Policy:

  • You may only use our site for lawful purposes that do not infringe upon, either local, national, or international laws or regulations, such as, but not limited to:
  • Engaging in any deliberately illegal or fraudulent activity, or having an illegal or fraudulent purpose or effect, to transmit, or cause to be sent, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam), either to us, to any person whose contact details are published on our site, or to any person whose contact details you subsequently acquire through our partner matchmaking services.
  • Not reproducing, duplicating, copying, or reselling any part of our site in violation of the terms accepted in the General Conditions.
  • Not sending automated queries of any kind through our site without our express prior authorization. Automated queries include attempts to collect email addresses or business websites using robots or spam spiders.
  • In case of dispute, Swiss law will be applied, regardless of the jurisdiction of the country of your residence or the location of the offense. Your consent includes your irrevocable acceptance that Swiss courts shall have exclusive jurisdiction to settle any dispute arising from, in accordance with, or in connection with these terms of use, and you agree to irrevocably submit to the decisions made under Swiss law. Any legal proceedings shall take place in Geneva, Switzerland.

Bilateral Cancellation and Penalty Policy:

  • Abusive cancellations that disregard the passenger’s time will result in the deactivation of your account on the platform.
  • Similarly, this applies to the cancellation of a booking made and confirmed with the client, which occurs beyond the tolerance period set at 3 minutes.
  • Essentially, you either cancel the trip before the 3-minute mark where cancellation is allowed, or you proceed with it and take responsibility after the 3 minutes.
  • All cancellations incur charges after three minutes during which the driver is en route to the passenger. The costs depend on the time spent and the kilometers traveled.
  • The passenger pays 0.50 CHF per minute of waiting time.
  • Cancellation fees will be charged if you cancel the trip after the timer expires. The total fare excludes road toll taxes and may change if your journey takes longer due to traffic or other factors. If you cancel after 3 minutes and the driver has accepted the trip, cancellation fees will apply.
  • Before accepting a trip, you have sufficient time to read the trip information and details. Once the driver accepts it, a contract is established, and cancellation beyond the tolerance period will be considered fraudulent and abusive.
Here are the payment instructions for Drivers & Riders using the SwissRyde platform:
  • The driver is responsible for collecting the fare, even if the payment is made by credit card. It’s important for both the client and the driver to read the messages displayed when the driver finishes the trip. The client must also complete any required actions in the app: payment, rating, or adding the driver to favorites, etc.
  • The client should not exit the vehicle until both the driver and the client have completed the trip on the app and payment has been made, whether by credit card, wallet, or soon, cash.
  • Payment must be made on the spot through the app, with both the driver and the passenger proceeding with payment and finalizing the trip in the app.
  • During the first use, the client should take the time to experience the service, make the payment, and add the driver to favorites before ending the trip.
  • If the client fails to make the payment, the driver will never receive their weekly earnings, and SwissRyde is not held responsible.
  • SwissRyde’s system operates similar to taxi counter, with fares displayed on the app’s counter according to the displayed prices.
  • These guidelines clarify the payment process and emphasize the importance for clients to finalize payment through the app so that the driver can receive their weekly earnings from SwissRyde.

Insurance and Security:

  • Accepting Terms of Use and Privacy Policy: By clicking « Sign Up », you agree to receive phone calls and SMS or WhatsApp messages, etc. from Switzerland to provide you with updates and information for marketing purposes. The frequency of messages depends on your activity. You can unsubscribe at any time by sending \STOP\ or by modifying notifications in your Application. Communication fees and data charges may apply.
Document Authentication:
  • You acknowledge that the documents you have uploaded are truthful and correct. You understand that any attempt to provide incorrect, misleading, or false information or documents will result in your immediate blacklisting from the Swiss Ryde platform.
  • Swiss Ryde reserves the right, if necessary, to report to the appropriate authorities regarding false documents.
  • The platform has been designed with security measures preventing access to document downloads by employees or even by the Swiss Ryde administrator. This means that the responsibility for these documents and their information lies entirely and legally with the drivers who have uploaded their documents themselves to their own accounts.
  • Before an account deactivation due to expired documents or an expired deadline, our system sends notifications in two stages. A first reminder is sent 30 days before the deadline, followed by a second reminder 15 days before expiration.
  • These notifications are specifically designed to give drivers enough time to submit the necessary documents. If you have already submitted these documents at the beginning of your activity and continue to receive requests, it may be due to an expiration date or required update.
  • We strongly encourage you to try uploading the requested documents again. If the issue persists, please feel free to contact us directly to help you quickly resolve this situation. It is essential for drivers to keep their information up to date in accordance with our requirements to ensure the security and compliance of our community.
Insurance:
  • SwissRyde is a work tool that assumes no liability and clearly and fully disclaims any type of insurance for anyone: vehicle, passengers, or others. Users (Drivers & Passengers) accept the general conditions before using the SwissRyde applications.

Privacy Policy:

  • SwissRyde is committed to ensuring users’ trust and preserving their fundamental right to privacy in accordance with Article 13 of the Swiss Federal Constitution and Swiss data protection laws (Federal Data Protection Act of June 19, 1992, LPD, and Ordinance on the Federal Data Protection Act of June 14, 1993), which stipulate that everyone has the right to privacy and protection against the misuse of their personal data. Consequently, SwissRyde firmly commits to maintaining this data in strict confidentiality and not selling or transmitting it to third parties without the express consent of the individual concerned.
We use cookies and data to:
  • Provide and maintain the SwissRyde application and services.
  • Track and pinpoint faults to protect our system against spam, fraud, and abuse.
  • Measure audience engagement and analyze site statistics to understand how our services are used in order to improve the quality of service we offer. The cookies used are small amounts of information placed on your computers, tablets, or mobile phones. Their role is to make our services simple, useful, and reliable, but they cannot be used to personally identify you.

Data Collection:
  • User image for profile picture using a camera or storage. With other users:
    We share certain information about users to enable ride planning and availability. This includes sharing.
    Passenger information shared with the driver includes name and photo, rating, pick-up and drop-off locations, number of rides, proposed fare, comments, and contact details.
    Driver information shared with the passenger includes name and photo, vehicle information and photo, location before and during the trip, ratings and reviews, number of trips, contact details.
    We may also be required to provide passengers with receipts and invoices containing information such as the origin and destination of the trip, total duration and distance of the trip, details of the total price, driver’s name, and tax identification number. We also include other information on these receipts if required by law.
    For other services purposes, we will share with other users the information necessary for planning and providing those services.

SwissRyde Driver:

  • As a driver using the SwissRyde Application, by clicking « Sign Up », you agree to the Terms and Conditions and the Privacy Policy of SwissRyde. You acknowledge and commit to adhering to the Swiss traffic code during all your trips, understanding that compliance with this code is essential for safety in accordance with Swiss transportation regulations. Additionally, you acknowledge that SwissRyde is not responsible for any infractions or violations of the Swiss traffic code that you may potentially commit as a driver. You accept full responsibility for any consequences resulting from your actions or inactions that contravene the code.
  • By accepting this charter, you pledge to uphold the highest standards of professionalism and responsibility towards passengers connected with you through SwissRyde, throughout all procedures and stages of the journey.

General Conditions – SwissRyde Wallet

Definition and Use of the Wallet
  • The SwissRyde wallet is a virtual account where you can deposit money to pay for your rides and subscriptions. Funds added to the wallet remain available until you use them for your trips or subscriptions.

Withdrawal of Funds
  • If you choose to withdraw funds from your wallet, a 20% fee will apply. This fee covers the costs of deposit and withdrawal transactions as well as the administrative fees associated with managing the service.
Acceptance of Terms
  • By using the SwissRyde wallet for payments, you automatically accept the general terms and conditions associated with this payment method.

General Conditions – SwissRyde Referral Program

Referral Code
  • To receive the referral reward, your friend must enter your unique referral code (passenger/driver HD… or HR…) during their registration, or use this code within 24 hours of its issuance.
Eligibility Requirements
  • Your friend must not be already registered as a passenger or driver with SwissRyde before the referral.
  • Your friend must complete 30 rides within 90 days of their registration.
Referral Reward
  • The referrer must have an active account and can receive up to 100 referral bonuses in total. The criteria and amounts of bonuses may vary depending on the city.
  • Rights and Reservations
  • SwissRyde reserves the right to withhold or deduct payments in cases of fraud or non-compliance with the conditions. This offer may be modified at any time.
Transport Services
  • Transport services are provided by independent drivers or partner companies. SwissRyde, as a Swiss cooperative, connects drivers and clients but does not provide direct transport services.
